NOTICE OF ANNUAL REVISED BUDGET HEARING AND VOTING DATE

BUDGET HEARING: June 3, 2026, WVCS Multipurpose Conference room 6:00 P.M. EDT

NOTICE IS HEREBY GIVEN that a public hearing (the “Budget Hearing”) for the qualified voters of the West Valley Central School District (the “District”) will be held on Wednesday evening, June 3, 2026, at 6:00 P.M. EDT in the WVCS Multipurpose Conference room, at 5359 School Street, West Valley, New York, for the presentation of the District’s proposed revised budget for the 2026-2027 school year.

NOTICE IS ALSO HEREBY GIVEN that the Annual Meeting (Budget Revote) of the District will be held on Tuesday, June 16, 2026, from 12:00 P.M. to 9:00 P.M. EDT in the Gymnasium for the purposes of: (i) voting on the revised budget for the 2026-2027 fiscal year; (ii) voting on the purchase of two (2) Chrysler Pacifica gasoline mini vans by utilizing that amount of funds currently on hand in the District’s Transportation Reserve Fund; and (iii) voting on the establishment of a Capital Improvements Reserve fund. 

NOTICE IS ALSO HEREBY GIVEN that copies of the proposed 2026-2027 revised budget and the propositions to be voted on at the budget Revote will be available in the District’s Main Office, at 5359 School Street, West Valley, New York, beginning June 3, 2026, through June 16, 2026, upon request, to District residents during normal school hours (8:00 A.M. to 4:00 P.M. EDT) Monday through Friday, except on holidays.  Copies will also be available through the June issue of the School Newsletter, at the Budget Hearing and at the Budget Revote.

NOTICE IS ALSO HEREBY GIVEN that the Board of Education of this district will have prepared and completed a detailed statement in writing of the amount of money which will be required during the 2026-2027 fiscal year for school purposes, specifying the several purposes and amount for each. Such statement shall be completed at least seven days before the budget hearing at which it is to be presented and copies thereof shall be prepared and made available, upon request, to residents within the District during the period of seven days before the budget hearing and/or fourteen days immediately preceding the annual meeting and election, and may be obtained by any resident in the District during the hours of 8:00 A.M. to 4:00 P.M. EDT on and after June 3, 2026, excluding Saturdays, Sundays or holidays, in the District Office or on our website at www.wvalley.org.
  
NOTICE IS ALSO HEREBY GIVEN that the qualified voters of the district shall be entitled to vote in the Budget Revote. A qualified voter is one who is (1) a citizen of the United States of America, (2) eighteen (18) years of age or older, and (3) resident within the West Valley Central School District for a period of thirty (30) days preceding the Budget Revote. 
NOTICE IS ALSO HEREBY GIVEN that the voting to be conducted at the Budget revote will consist of voting on the following three propositions: 

PROPOSITION NO. 1
PROPOSED REVISED BUDGET 2026-2027

Shall the following resolution be adopted?
RESOLVED, that the revised budget for the West Valley Central School District (the “District”) for the fiscal year commencing July 1, 2026, and ending June 30, 2027, as presented by the Board of Education of the District, in the amount of $10,558,807, is hereby approved and adopted and the required funds therefor are hereby appropriated and the necessary real property taxes required shall be raised by a tax on the taxable property in the District to be levied and collected as required by law.


PROPOSITION NO. 2
PURCHASE OF TWO MINI VANS 
FOR THE TRANSPORTATION PROGRAM OF THE DISTRICT

Shall the following resolution be adopted?

RESOLVED, that the Board of Education (the “Board”) of the West Valley Central School District, Cattaraugus County, New York (the “District”) is hereby authorized to purchase two (2) mini vans and related equipment and supplies at a maximum estimated cost of $92,451 for use in the transportation program of the District, utilizing $92,451 from funds currently on hand in the District’s “Transportation Reserve Fund” that was established by the voters of the District in May of 2021.

PROPOSITION NO. 3
ESTABLISHMENT OF A CAPITAL IMPROVEMENTS RESERVE FUND, 2026

Shall the following resolution be adopted?

RESOLVED, that the Board of Education (the “Board”) of the West Valley Central School District, Cattaraugus County, New York (the “District”) is hereby authorized to establish a capital improvements reserve fund pursuant to Section 3651 of the Education Law of the State of New York (the “Fund”); that the Fund shall be known as the “Capital Improvements Reserve Fund, 2026” of the District; that the Fund shall be established for the purpose of financing, in whole or in part, the acquisition, construction, reconstruction, expansion, renovation, alteration, and improvement of buildings, facilities, sites, and real property by the District, or the District’s share of the cost of any capital improvements project undertaken by a Board of Cooperative Educational Services (“BOCES”) of which the District is (or may become) a component district, including, in all cases, the acquisition of necessary furnishings, equipment, machinery, and apparatus; that the ultimate amount of the Fund shall be not greater than $1,500,000 (plus interest earned thereon); that the probable term of the Fund shall be not longer than ten (10) years; and that the permissible sources from which the Board is authorized to appropriate monies to the Fund from time to time shall be (A) amounts applied thereto from budgetary appropriations of the District; (B) unappropriated fund balance of the District as directed by the Board; (C) State aid received as reimbursement for expenditures by the District in connection with District capital improvements (whether or not such expenditures were financed in whole or in part from the Fund); (D) the proceeds from the sale of unneeded real or personal property owned by the District, if permitted by law and if so directed by the Board; (E) one or more other reserve funds of the District; and/or (F) such other sources as the Board or the voters of the District may direct from time to time, all as may be permitted by law.

NOTICE IS ALSO HEREBY GIVEN that to be eligible to vote at the Budget Revote, residents of the District must be properly registered. A person is properly registered if the person has registered for general election purposes or has registered for school election purposes during the four calendar years prior to the year in which the register is being prepared. Alternately, if such voters have a New York State Driver's license, they may register to vote electronically through the Department of Motor Vehicles at https://dmv.ny.gov/more-info/electronic-voter-registration-application. All other persons who wish to vote must present themselves for personal registration.

NOTICE IS ALSO HEREBY GIVEN that any person shall be entitled to have his or her name placed upon the register of qualified voters of said District, providing that at any of the meetings of the Board of Registration set forth above he or she is known or proves to the satisfaction of such Board of Registration to be then or thereafter entitled to vote at the school meeting for which said register is prepared; registration of qualified voters of said School District will also include the names of all persons who shall have previously voted in annual or special meeting or any election held or conducted during 2022, 2023, 2024 and 2025, the register so prepared will be filed in the Office of the Clerk of the said District and will be open for inspection by any resident of the District between the hours of 8 a.m. and 4 p.m. Monday through Friday. Any qualified voter may, upon examination of the registered file a challenge of the qualifications as a voter of any person whose name appears on such registered by filling out blanks, under oath, as provided by the Board.

NOTICE IS ALSO HEREBY GIVEN that only those qualified voters whose names appear on the School District Register List specified above, or those persons who are otherwise qualified to vote and who are registered under the provisions of Article 15 of the Election Law for general election purposes and whose names appear on the registration lists delivered to the School District by the Cattaraugus County Board of Elections, as required law, will be entitled to vote at the Budget Revote.

NOTICE IS ALSO HEREBY GIVEN that pursuant to a rule adopted by the Board under §§2035 and 2008 of the Education Law, any referenda or propositions to amend the budget, or otherwise to be submitted for voting at the Budget Revote must comply with the Board’s adopted rules set forth in District Policy 1650. However, the Board will not entertain any petition to place before the voters any proposition the purpose of which is not within the powers of the voters to determine, or any proposition which fails to include a specific appropriation where the proposition requires the expenditure of monies. Printed copies of the policy are available at the District Clerk’s Office.

NOTICE IS ALSO HEREBY GIVEN that applications for absentee ballots may be applied for at the Office of the District Clerk. Applications for absentee ballots must be received by the District Clerk by or prior to 5:00 pm (EDST) on June 9, 2026, seven (7) days before the Annual Vote, if the ballot is to be mailed to the voter; or prior to 5:00 pm (EDST), on June 15, 2026, one (1) day before the Annual Vote, if the ballot is to be issued personally to the voter. A list of all persons to whom absentee ballots shall have been issued will be available for inspection in the Office of the District Clerk on each of the five (5) days prior to the day of the Annual Vote (except Sunday), and such list shall also be posted at the voting place during the election, and any qualified voter may inspect said list and challenge the acceptance of the absentee voter’s ballot of any person on such list, by making his challenge and the reasons therefor known to the Inspector of Election before the close of the polls.
